- These terms are between you and the makers of Rememberly.
- You can use the app on your Apple devices for personal use.
- During the TestFlight beta, the app is free and may have rough edges.
- Your data is yours, on your device. See the Privacy Policy.
- We make Rememberly with care, but we provide it "as is" — we can't guarantee it's perfect.
Agreement
By downloading, installing, or using Rememberly (the "app"), you agree to these Terms of Use. If you don't agree, please don't use the app. These terms are between you and the people who make Rememberly ("we", "us", "our").
Who can use Rememberly
You need to be at least 13 years old (or the minimum age in your country, if higher) to use Rememberly. By using the app, you confirm that you meet that requirement and have the legal capacity to enter into this agreement.
Your license to use the app
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use Rememberly on Apple devices that you own or control, for your own personal, non-commercial use, subject to these terms and the App Store Terms of Service.
You agree not to:
- copy, modify, distribute, sell, rent, lease, or sublicense the app;
- reverse-engineer, decompile, or attempt to extract the source code, except where local law permits this despite a contractual restriction;
- use the app to do anything illegal, harmful, or that infringes anyone else's rights;
- circumvent or interfere with any security, integrity, or rate-limiting features.
The TestFlight beta
Rememberly is currently distributed through Apple's TestFlight as a pre-release version. Beta software is, by its nature, unfinished. That means:
- Things may break, look wrong, or change without notice.
- Data you put into a beta build may be lost when you update or when the beta period ends.
- Features may be added, removed, or significantly changed before the public release.
- The beta is provided for testing and feedback only, free of charge.
We strongly recommend keeping your own backup of anything important during the beta period. Apple's general TestFlight terms also apply when you use the TestFlight app.
Your data and content
Anything you put into Rememberly — the people you add, the notes you write, the dates you save — belongs to you. We do not claim any ownership of it.
Your data is stored on your device, and (if you choose to enable iCloud sync) inside your private iCloud account, which we cannot read. You are responsible for the content you create in the app and for keeping appropriate backups. For details on how data is handled, see the Privacy Policy.
Pricing
During the TestFlight beta, Rememberly is free to use. After the public launch on the App Store, the app will move to a small one-time purchase price — there is no subscription. As a thank-you, beta testers will continue to have free access to the app after launch.
If pricing changes in the future, the change will only apply to new purchases, not to people who have already paid.
App Store and Apple
If you obtained Rememberly through the App Store, the following also applies:
- This agreement is between you and us, not between you and Apple. Apple is not responsible for the app or its content.
- Apple has no obligation to provide any maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, who will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation.
- Any product liability claims, claims that the app fails to conform to any legal requirement, or claims arising under consumer protection law are our responsibility, not Apple's.
- If a third party claims the app infringes their intellectual property rights, we (not Apple) are responsible for investigating and resolving the claim.
- You confirm that you are not located in a country subject to a U.S. Government embargo, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and Apple's subsidiaries are third-party beneficiaries of this agreement and may enforce these terms against you.
Disclaimers
We make Rememberly with care, but the app is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that any data you store will be preserved without loss.
You use the app at your own discretion and risk.
Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of data, profits, or use, arising out of or in connection with your use of Rememberly — even if we have been advised of the possibility of such damages.
Our total liability for any claim relating to the app will not exceed the amount you have paid us for the app in the twelve months before the claim arose, or, if you have not paid anything, ten US dollars.
Some jurisdictions don't allow the exclusion or limitation of certain damages, so some of the above may not apply to you. In those cases, our liability is limited to the smallest extent permitted by law.
Termination
You may stop using Rememberly at any time by deleting the app from your device. We may suspend or end your access to the app if you breach these terms. The sections of these terms that by their nature should survive termination — including the disclaimers, limitation of liability, and these closing terms — will continue to apply.
Changes to these terms
We may update these terms from time to time. If we make a material change, we'll update the "Last updated" date at the top and, where appropriate, let you know inside the app. By continuing to use Rememberly after a change takes effect, you agree to the updated terms.
Governing law
These terms are governed by the laws of Portugal, without regard to its conflict-of-laws rules. To the extent permitted by law, any dispute arising out of or relating to these terms or your use of Rememberly will be brought in the competent courts of Portugal. Nothing in this section limits any non-waivable rights you may have under the consumer protection laws of the country where you live.
